DOD Announces 'Fix' To Gay Web Site Ban That Doesn't Fix Anything

The Pentagon yesterday issued a memo apparently intended to at least partly "fix" the problem whereby a number of Defense Department computers were banning access to gay and trans Web sites, in addition to other liberal political content, while not banning similar conservative and anti-gay Web sites. The problem is that the new Pentagon memo doesn't really fix a thing.

Pa. gov's filing defends antitrust suit vs. NCAA

(AP) ? Gov. Tom Corbett argued in a court document filed late Monday that the NCAA has been trying to use his antitrust lawsuit against it over the Penn State penalties in the Jerry Sandusky child sex abuse scandal to combat what he describes as a groundswell of public criticism.

Corbett said the judge should not grant the NCAA's request to dismiss the case, saying college sports' governing body made a factual error when it said the penalties were voted on by the university's trustees.

Corbett, who as governor is a trustee, said the NCAA's motion to dismiss the lawsuit he filed in early January "appears to have been written more to advance the NCAA's broader agenda, and to combat the recent groundswell of public criticism against the embattled organization, than to raise legal issues appropriate to a motion to dismiss."

NCAA spokeswoman Emily Potter offered no immediate comment on the latest filing.

The Republican governor's lawsuit asks the judge to throw out all the penalties, including a $60 million fine, a four-year bowl ban and the loss of football scholarships. He claims the consent agreement has harmed students, business owners and others.

"The NCAA wrongly claims that its arbitrary decimation of the PSU football program is no different than its enforcement of rules regulating player eligibility or uniforms ? which do enhance collegiate competition ? although PSU was not found to have violated a single NCAA rule and the NCAA's own president insisted that the consent decree was not an enforcement action," Corbett's lawyers wrote.

The NCAA has said the penalties are unrelated to regulation of economic activity so antitrust law doesn't apply.

Sandusky, a former defensive coordinator at the college football powerhouse, was convicted last summer of sexually abusing several boys, some on campus. He is serving a 30- to 60-year state prison sentence. He is appealing and maintains his innocence.

The consent agreement between the NCAA and Penn State was signed a few weeks after Sandusky was found guilty of 45 criminal counts. Penn State is not a party to Corbett's antitrust lawsuit or to the NCAA's lawsuit filed last week against Corbett and three state officials over a newly enacted state law that is designed to keep the $60 million within the state.

Obama urges Congress to compromise on cuts

WASHINGTON (AP) ? Facing an end of the week deadline, President Barack Obama said Monday that Congress can avert sweeping across-the-board cuts with "just a little bit of compromise," as he sought to stick lawmakers with the blame if the budget ax falls.

Speaking to the nation's governors, Obama acknowledged that the impact of the $85 billion in cuts may not be felt immediately. But he also said the uncertainty already is impacting the economy, as the Pentagon and other agencies get ready to furlough employees.

"At some point we've got to do some governing," Obama said. "And certainly what we can't do is keep careening from manufactured crisis to manufactured crisis."

Despite Obama's urgent rhetoric, there is no indication that the White House and Congress were negotiating a deal to avoid cuts by Friday's deadline. White House press secretary Jay Carney said he had no new telephone calls to announce since the president's conversations with Republican congressional leaders last week. "We will continue to engage with Congress this week," Carney said.

Obama wants to offset the so-called sequester through a combination of targeted spending cuts and revenue increases, but Republicans oppose any plan that would include tax hikes.

Emerging from a closed-door meeting with Obama, governors said the president had assured the administration is pursuing solutions, but didn't offer assurances that officials would find a way ahead out ahead of the deadline.

The $85 billion budget-cutting mechanism could affect everything from commercial flights to classrooms to meat inspections. Domestic and defense spending alike would be trimmed, leading to furloughs for hundreds of thousands of government workers and contractors.

Defense Secretary Leon Panetta has said the cuts would harm the readiness of U.S. fighting forces. Transportation Secretary Ray LaHood said travelers could see delayed flights. Education Secretary Arne Duncan said 70,000 fewer children from low-income families would have access to Head Start programs. And furloughed meat inspectors could leave plants idled.

The White House continued laying out in stark terms what the cuts would mean for government services, dispatching Homeland Security Secretary Janet Napolitano to warn of the implications for critical security functions.

"I don't think we can maintain the same level of security at all places around the country with sequester as without sequester," said Napolitano, adding that the impact would be "'like a rolling ball. It will keep growing."

Despite the Friday deadline, there are no serious negotiations happening between the White House and Congress. Obama is focused instead are trying to rally public support for his stance in the debate by warning Americans of the dire consequences of the across-the-board cuts.

The president told the governors that cuts would "''slow our economy, eliminate good jobs, and leave a lot of folks who are already pretty thinly stretched scrambling to figure out what to do."

The spending cuts have frustrated governors attending the National Governors Association meeting in Washington. They contend it has created widespread uncertainty in the economy and hampered economic recovery in their states.

"The president needs to show leadership," said Louisiana Gov. Bobby Jindal, a Republican considered a potential 2016 presidential contender, outside the West Wing. "The reality is it can be done. This administration has an insatiable appetite for new revenue."

Democratic governors, meanwhile, laid responsibility squarely at the feet of Congress, but called on lawmakers from both parties to compromise.

"They need to get out of that box that sits under the dome and understand that this has real implications in people's lives," said Connecticut Gov. Dannel Malloy. "Work with the president, find a way to get it done ? or if you want, just turn it over to us governors, and we'll negotiate."

The White House, seeking to ratchet up pressure on congressional lawmakers, gave the governors state-by-state reports on the impact of the cuts on their constituencies.

White House officials pointed to Ohio ? home of House Speaker John Boehner ? as one state that would be hit hard: $25.1 million in education spending and another $22 million for students with disabilities. Some 2,500 children from low-income families would also be removed from Head Start programs.

Officials said their analysis showed Kentucky would lose $93,000 in federal funding for a domestic abuse program, meaning 400 fewer victims being served in Senate Minority Leader Mitch McConnell's home state. Georgia, meanwhile, would face a $286,000 budget cut to its children's health programs, meaning almost 4,200 fewer children would receive vaccinations against measles and whooping cough.

The White House compiled its state-by-state reports from federal agencies and its own budget office. The numbers reflect the impact of the cuts this year. Unless Congress acts by Friday, $85 billion in cuts are set to take effect from March to September.

As to whether states could move money around to cover shortfalls, the White House said that depends on state budget structures and the specific programs. The White House did not have a list of which states or programs might have flexibility.

Republican leaders were not impressed by the state-by-state reports.

"It's time for the White House to stop spending all its time campaigning, and start finding smarter ways to reduce the deficit," said McConnell.

Afghan president orders US forces out of key province

Afghanistan's President Hamid Karzai has ordered that all U.S. special forces must leave Wardak province, just west of Kabul, within two weeks ? citing allegations of disappearances and torture.

In a statement Sunday, a spokesman for Karzai said, "after a thorough discussion, it became clear that armed individuals named as U.S. special force stationed in Wardak province engage in harassing, annoying, torturing and even murdering innocent people."


Karzai's office cited a "recent example" in which nine people allegedly "disappeared" and a separate incident where a student was taken from his home in the middle of the night and whose tortured body was found two days later under a bridge with his throat cut.

U.S.?defense officials strongly deny that military personnel condoned, or were involved in, any kidnappings, torture or murders of Afghan civilians or suspects.

In addition to demanding the U.S. pull out in two weeks, Karzai also demanded the immediate cessation of all international special forces operations in Wardak.

Military?officials told NBC News that Karzai's order came as a total surprise. The province is one of the hottest combat zones in Afghanistan and?is a strategically important area because it is seen as the gateway the Taliban uses to carry out attacks in Kabul, the war-torn nation's capital.

In response, International Security Assistance Force, which coordinates the multinational coalition in Afghanistan, said "the U.S. Forces Afghanistan is aware of the reporting of presidential spokesman Aimal Faizi's comments today. We take all allegations of misconduct seriously and go to great lengths to determine the facts surrounding them."

The ISAF declined to comment further until they've "had a chance to speak with" senior officials in the Afghan government.

In their statement, the Afghan government noted that "Americans reject having conducted any such operation," but also noted "that such actions have caused local public resentment and hatred."

President Barack Obama announced during his State of the Union address earlier this month that 34,000 American troops --? about half of the total U.S. force in Afghanistan -- will leave the country by the end of this year.

Thailand's demand for final energy will double within the next 25 years if consumption continues at the current rate, and with its limited resources, the Kingdom will likely remain a net energy importer to meet its increasing demands, according to a forecast by the Asia Pacific Energy Research Centre.

"Final energy" is that available to the user after conversion from primary energy sources such as petroleum, nuclear, wind or the sun. Electricity is a form of final energy.

APERC's report, "Asia Pacific Energy Demand and Supply Outlook", released yesterday, said demand would grow at an average annual rate of 2.6 per cent over the period, driven mainly by increased demand in the "other" sector (which covers residential, commercial and agricultural use) and in the non-energy sector. Demand in the "other" sector is expected to increase at an annual average of 3 per cent over the period, to 40 million tonnes of oil equivalent (Mtoe) in 2035.

"A large percentage of 'other' sector demand will be for electricity in the commercial sub-sector and for oil in the agricultural sub-sector," the report said. "The likely increase in home-appliance ownership, and its impact on residential demand, varies between types of home appliance. In 2010, air-conditioners were owned by only 15.6 per cent of the households, which is a long way below saturation level. In comparison, television and fan ownership levels are much higher: 96 per cent of households own a television and 97 per cent own fans."

In 2035, industrial and non-energy-sector use together will account for 48 per cent of the total final energy demand, while transport will account for 27 per cent and "other" sector demand for 25 per cent.

Thailand's energy conservation and efficiency campaign through various measures, including building codes and minimum efficiency performance standards for appliances, is expected to moderate electricity demand in this sector.

The domestic transport sector's energy demand will be affected by increasing vehicle numbers (which are still far below saturation level) and the increase in vehicle-kilometres travelled. Demand will be moderated by the gradual shift in transport modes in urban centres (to rapid-transit systems) and a modest increase in the use of biofuels and alternative vehicles.

The light-vehicle fleet in Thailand will be more diverse by 2035. Hybrids and plug-in vehicles will account for 4 per cent of the fleet, while autos running on liquefied petroleum gas and natural gas for vehicles will account for 7 per cent.

High demand means Thailand, already a net energy importer, has to import more.

Even as Thailand prepares for a possible electricity crisis in April due to the halt in gas supply from Myanmar, APERC foresees greater long-term demand for natural gas here, especially for electricity generation. Natural gas will be the most rapidly growing primary energy source, at an annual average rate of 4.4 per cent per year from 2010 to 2035.

"Thailand's limited gas production will require the economy to increase its gas imports almost fourfold from 7.5Mtoe in 2009 to 27Mtoe in 2035," it said.

Thailand imports about 1,100 million cubic feet per day of natural gas from Myanmar. Liquefied natural gas (LNG) has also been used as a fuel for electricity generation since 2011.

The Map Ta Phut LNG Terminal, Thailand's first LNG re-gasification terminal, was inaugurated in Rayong province in September of that year. The terminal has an initial capacity of 5 million tonnes per annum.

Through 2035, while oil and gas will account for more than 65 per cent of total primary energy supply, new renewable energy sources are expected to grow by 77 per cent over the period, and will account for 19 per cent of the 2035 total. In this BAU (business-as-usual) projection, Thailand will likely introduce nuclear power into the primary-energy fuel mix from 2027 onwards.

Oil imports are expected to grow at an average annual rate of 3.4 per cent, to 80Mtoe in 2035. This is to meet the projected demand for oil, especially in the domestic transport and non-energy sectors over the outlook period. Coal imports are expected to grow at an annual average of 2.3 per cent from 2010 to 2035, mostly serving the industrial sector and electricity generation.

The BAU scenario also indicates Thailand's high dependency on fossil fuels will likely result in the further increase of carbon-dioxide emissions and environmental pollution.

    Louisville withholds allegations vs. former Miami Hurricanes assistant coach Clint Hurtt

    The University of Miami?s NCAA saga stretched into another day Friday, with few developments publicly revealed.

    The University of Louisville still is withholding the Notice of Allegations for former UM football assistant coach Clint Hurtt, whose allegations have been received, Louisville acknowledged earlier this week.

    Louisville is a public school and by law is required to distribute the information to those who formally make a public records request.

    A source close to Hurtt told The Miami Herald that he will be fighting some of the allegations. His athletic director, Tom Jurich, defended Hurtt?s character this week, saying, ?Since Clint?s been here, he has never done an iota wrong. ? He?s been exemplary here. He?s done a great job. He?s never bent a rule here, let along broke one. To me, he?s earned a lot of equity from that.?

    A conference call that had been scheduled for Friday with the NCAA?s Committee on Infractions took place in the morning, according to a Miami Herald source. Former Miami basketball assistant coaches Jake Morton and Jorge Fernandez, as well as former football wide receivers coach Aubrey Hill, filed a motion asking for their individual cases to be tossed out because of the botched NCAA investigation, The Associated Press reported. The AP cited an unnamed source indicating the Committee on Infractions agreed to ?consider the request? of the three former UM assistants, adding that the hearing would be held during the originally scheduled June14-15 dates, not in July.

    Also on Friday, UM Board of Trustees chair Leonard Abess had a letter that he authored published in the Opinion section of The Miami Herald, on behalf of the UM trustees.

    ?Despite the often unwieldy investigation, the [UM], at President [Donna] Shalala?s and the Board of Trustees? insistence, has held itself to the highest standards in its model cooperation with the NCAA,?? Abess wrote. ??While I believe that the [UM] will emerge stronger and more committed than ever to the letter and the spirit in which the NCAA?s rules of conduct were established, the trustees respectfully, but firmly, add our own voice to President Shalala?s in asking that no further sanctions be imposed ??

    France's Hollande urges compulsory labeling amid horsemeat scandal

    PARIS (Reuters) - French President Francois Hollande called for compulsory labeling and traceability of meat used in processed foods in Europe to prevent a repeat of the horsemeat scandal.

    French and German agriculture ministers said on Friday they agreed on the need for origin labeling and would try to find a deal on meat traceability at a meeting of European farm ministers in Brussels on Monday.

    "There needs to be traceability, that is what I want from talks on a European level," Hollande said on Saturday.

    "We need compulsory labeling on meats that will be used in processed foods," Hollande said at the start of the annual agriculture fair in Paris.

    He added that while waiting for European legislation, France would encourage voluntary initiatives to improve labeling.

    The EU wants to put regulation in place to avoid a repeat of a scandal that burst after horsemeat was found instead of beef in products around the bloc.

    The scandal, which has triggered recalls of ready meals and damaged confidence in Europe's vast food industry, erupted last month when tests carried out in Ireland revealed that some beef products contained horsemeat.

    Other cool stuff we should know about: Something that we both wanted for our wedding ceremony was to write our own vows and officiate ourselves. Being two introverts, this was probably a surprising choice, but it felt right. We had both arrived at the decision to get married after careful consideration, so we felt that this was a way to really own this new chapter in our lives. Pronouncing ourselves husband and wife was a really awesome and empowering moment for us.

    Also during that weekend, our families met for the first time. I?m originally from Illinois and Casey?s from Virginia, so there had not been a chance for them to meet previously. My favorite moment was sitting around our dining room the day before with my family and Casey?s mom. We chatted and joked and caught up, and it felt so natural and easy to have everyone together.

    Favorite thing about the wedding: (Really hard to decide on just one moment, but?) Towards the end of dinner, the West Philadelphia Orchestra made a surprise entrance as they filed into the dining area and started playing music. It was so fun and joyful and got everyone off their bums and dancing.

    Nevada legalizes first interstate online poker

    (Reuters) - Nevada Governor Brian Sandoval has signed legislation legalizing online gambling, after quick approval of the bill by state lawmakers, in a move that comes as New Jersey weighs a similar measure.

    "This bill is critical to our state's economy, and ensures that we will continue to be the gold standard for gaming regulation," Sandoval said in a statement after signing the bill on Thursday.

    The bill removes the provision requiring federal legislation or Department of Justice approval before online gaming licenses are made active, the statement said.

    It comes as New Jersey - another major gambling hub - considers a similar move to legalize online gambling. Governor Chris Christie rejected a measure earlier this month that would have allowed Internet gambling, but has said he would consider approving such a law if it was framed properly.

    The law requires the Nevada Gaming Commission to adopt regulations authorizing the governor to enter into agreements with other states to conduct interactive gambling.

    The signing came after a joint Judiciary committee hearing on Thursday morning and approval by the legislature in the afternoon, the statement said.

    Pwn Pad is a Nexus 7-based network hacking machine

    Security tools company Pwnie Express is making a network hacking-focused device, based on the Nexus 7, called the Pwn Pad. This certainly isn't a tablet meant for the mainstream, but instead is a purpose-built hacking device for users that are interested in tinkering with networks. Unfortunately a completely custom build of software doesn't overcome some limitations of the hardware, and users will have to take advantage of the included OTG cable and wireless adapter on it to support packet injection. The upside is a 10-fold increase in possible Wifi range on the Pwn Pad.

    The Pwn Pad is set to debut at the RSA security conference in San Francisco next week, and the price is set at a smooth $795. That's a pretty penny, but this is a full-on custom job with additional hardware attached to it. For those of you without an extra $800 to spend, Pwnie Express is releasing source code for the devices for others to work with on their own.

    The 40-yard dash is the marquee event of the NFL Scouting Combine, but it?s also often disparaged by those who say that a player?s speed in running 40 yards in a straight line while wearing shorts and a T-shirt does not say much about what kind of football player he is.

    Count longtime NFL executive Bill Polian among those who say the 40 does, in fact, matter.

    Polian, who ran the draft room for the Bills for eight years, the Panthers for three years and the Colts for 15 years, said on NFL Live that when he looks at the ways a player can show his stuff at the Combine, it begins with showing off his pure speed.

    ?No. 1, the 40 times. If you are a believer in speed ? and I am, and was ? the 40 times are very important,? Polian said.

    Polian said that while he wouldn?t get too obsessed with separating players by the hundredths of a second, there are certain 40 times that a player simply has to meet if he wants to be considered a high-level draft prospect at his position.

    ?There are benchmarks,? Polian said. ?A guy doesn?t need to run a 4.42 as opposed to someone who runs a 4.43, but they have to get under the barrier that a club sets for each position. So a receiver who?s more than 4.5? His stock?s going to fall, and there?s no two ways about it.?

    Polian had some big first-round hits by drafting for speed early in his tenure with the Colts, including Edgerrin James, Reggie Wayne and Dwight Freeney. Unfortunately for Polian, he missed with speedy first-round picks like Donald Brown, Anthony Gonzalez and Jerry Hughes later in his tenure.

    Those misses do not, however, shake Polian?s belief in the 40.

    Why living against the clock is a risky business

    Living against the clock?working late-night shifts or eating at inappropriate times, for example?can come with real health risks, metabolic syndrome, obesity, and diabetes among them. Now, researchers reporting in Current Biology, a Cell Press publication, on February 21 have new evidence to explain why it matters not just what mice (or by extension, people) eat, but also when they eat it.

    Insulin action rises and falls according to a 24-hour, circadian rhythm, the researchers found. What's more, mice unable to keep the time for one reason or another get stuck in an insulin-resistant and obesity-prone mode.

    "We used to think some things were so important that they must be kept constant," says Carl Johnson of Vanderbilt University. "But those metabolic set points are changing as a function of the time of day."

    Johnson's team took careful measurements of insulin in mice at different hours to reveal a regular pattern. Normal mice become insulin resistant during the day, when the nocturnal animals are mostly sleeping. Mice made unable to keep the time based on a genetic defect or constant exposure to light lost that rhythm. They also gained more weight when fed on high-fat mouse chow.

    That responses to insulin would vary over the course of a day makes sense, even if it isn't the way scientists or doctors have often thought about it.

    "From the work of Claude Bernard in the 19th century, the concept of homeostasis as the maintenance of a constant internal environment is deeply ingrained in our thinking about how organisms work," the researchers write. But it's also wrong, Johnson argues, for the simple reason that an animal's environment follows an obvious daily rhythm too. Evolution will favor organisms that have an optimal response to that environment, which is rhythmic.

    And so it is that insulin action and blood sugar metabolism are tied to the time of day and to the internal mechanisms that keep track of that time. It's a challenging reality for us humans, living as we do today in the comfort of our homes, where the lights come on at the flip of a switch and the food is plentiful.

    "Mediterranean diets in which the main meal is eaten in the middle of the day are probably healthier," Johnson says. It's probably best to eat a light supper and avoid snacking after dinner.

    Diets that only limit when people eat surely won't reverse the epidemic of obesity, he says, but they would probably help.

    Microsoft lapse cause outages in Azure service

    REDMOND, Wash. (AP) ? Microsoft unwittingly let an online security certificate expire Friday, triggering a worldwide outage in an online service that stores data for a wide range of business customers.

    The sloppy housekeeping represents an embarrassing lapse for Microsoft Corp. as the software maker tries to bring in more revenue from the storage service, which is called Azure.

    The expired certificate is needed to properly run online services such as Azure which use an "https" protocol to block unauthorized users from accessing information.

    Microsoft's failure to renew the security certificate apparently caused the Azure service to go down shortly before 4 p.m. EST Friday. The breakdown prevented Azure customers from accessing files kept in Microsoft's data centers.

    The service still hadn't been fully restored more than four hours later, according to a post on Microsoft's website.

    "We apologize for any inconvenience this causes our customers," Microsoft said.

    Azure's failure illuminates the pitfalls of storing important information in remote data centers. Online storage, often called "cloud computing," is growing in appeal because it allows workers to pull up data, wherever they are, to an Internet-connected device.

    Cloud computing's convenience can turn into a major aggravation when a problem crops up like the one that tripped up Microsoft Friday.

    Caterpillar Foundation and Global Communities Launch $4.4 Million Partnership to Improve Job Prospects for Youth in Middle East and North Africa

    Three-year program designed to help place disadvantaged young people in labor market

    SILVER SPRING, Md., Feb. 21 /CSRwire/ - The Caterpillar Foundation and Global Communities today announced a $4.4 million, three-year partnership to prepare youth in Jordan, Lebanon and Yemen for the labor market and job placement. The Middle East and North Africa Youth Empowerment Strategy (MENA-YES), which targets young people aged 15-29, will place special emphasis on disadvantaged youth, low- to medium-level skilled individuals, women, rural youth, and individuals working in hazardous environments.

    MENA-YES will emphasize building solid linkages with the private sector and potential employers to determine the precise nature, scale and timing of needed skills to ensure placement of trainees. By building upon its 18-year presence in the region, Global Communities will provide up to 1,920 youth with demand-driven training to prepare them for labor opportunities. At least 60 percent of those placed in internships/apprenticeships or receiving technological training will be on track to be employed or to pursue further training 180 days after completion of program activities.

    Additionally, more than 1,000 youth will receive training in financing, market development and business management skills to help them develop entrepreneurial skills. Of these, at least 230 youth will be linked with banks and credit opportunities.

    The program is critically important given that the region has the highest youth unemployment rate in the world, estimated in 2010 at 25 percent, and 30 percent for young women alone. ?Given the size of rural populations in the region, illiteracy rates, underemployment, and employment that is transient, cyclical and short-term, these estimates are probably low,? says David Weiss, President and CEO of Global Communities.

    ?The numbers are likely to worsen over the next decade, given the high number of youth entering the labor markets,? says Weiss. ?These problems make the Middle East North Africa region ripe for this kind of partnership, which directly helps those most affected by the dire labor market and ensures that they have the training and jobs to support themselves and their families.?

    ?The Caterpillar Foundation is delighted to partner with Global Communities to address one of the most pressing needs facing the Middle East and North Africa. This is a forward-looking, regionally focused program, which will leverage public and private sector expertise to bring about the greatest positive impact on community needs,? said Caterpillar Foundation President Michele Sullivan.

    The MENA-YES program is the first multi-country initiative that Global Communities and the Caterpillar Foundation have launched in the region. Global Communities has been active in the Middle East since 1995. Its work has included U.S. Department of Labor funded programs in Jordan, Lebanon and Yemen, which facilitated the provision of formal and informal education and vocational training to children at risk of entering child labor and children withdrawn from child labor.
