Snowden's remaining docs unlikely to tie US hands

WASHINGTON (AP) ? It's the stuff of spy novels: The hunted-down protagonist wins in the end because he's got damaging documents squirreled away, a bargaining chip against the bureaucrats who want to silence him.

If National Security Agency leaker Edward Snowden thinks he's living in such a thriller, legal experts say he's got another think coming. Nothing he has is likely to scare off the prosecution.

Snowden, stuck at a Russian airport while he seeks asylum from several countries, has not overtly threatened the U.S. that he would release more damaging documents. But the journalist through whom he has been working, Glenn Greenwald, has said that blueprints that detail how the NSA operates will be made public if something should happen to Snowden.

"This is his insurance policy," said Greenwald, a columnist with Britain's Guardian newspaper who received Snowden's initial leaks and who communicates with the former NSA systems analyst. In a July 13 article in the Argentine newspaper La Nacion, Greenwald said, "The U.S. government should be on its knees praying every day that nothing happens to Snowden, because if something does happen, all the information would be revealed and this would be its worst nightmare."

The Justice Department is not discussing its prosecution strategy. But while the U.S. isn't eager for any more classified information to be disclosed, there's little chance Snowden will be able to use what he has as a bargaining chip to negotiate his prosecution or extradition. That's because giving into threats would risk opening the door for others to take similar action in the future.

The government must take the position: "We don't negotiate with extortionists," said Michael Chertoff, the former head of the Justice Department's criminal division and former secretary of someland security. Chertoff said he can't recall a case in which the U.S. government has caved under this type of threat.

"I'm betting that there is virtually nothing that Snowden could do or threaten to persuade the (U.S. government) not to prosecute," said Peter Zeidenberg, a former federal prosecutor who was on the team that prosecuted I. Lewis "Scooter" Libby, the Bush administration official who revealed the name of a CIA officer. Zeidenberg said doing so would send a damaging message from the U.S.: "If you are going to steal secrets, get the crown jewels; that way, the government will never dare to prosecute."

Snowden leaked details of two top secret U.S. surveillance programs. He has been charged with three offenses, including espionage, and could face up to 30 years in prison if convicted. Russian President Vladimir Putin has said that if Snowden releases any more of the materials, Russia will not grant him temporary asylum.

"If the Obama administration responds with an even harsher hand against me, they can be assured that they'll soon find themselves facing an equally harsh public response," Snowden said in a June 17 online question-and-answer forum.

"Snowden has information enough to cause more damage to the U.S. government in a single minute than any other person has ever had in the history of the United States," Greenwald said in the article in La Nacion.

Mark Zaid, an attorney who has represented people charged with espionage, said these threats from Snowden and Greenwald are a form of graymail, a tactic in which defendants charged with spying try to force the government to drop the charges by threatening to expose U.S. secrets on the witness stand.

Zaid said every time Snowden releases more documents it could create additional criminal charges. Zaid is not working on Snowden's defense and hasn't been contacted by the leaker. But if he were representing Snowden, Zaid said, "I'd tell him to shut up" and accept the marriage proposal from Russian spy Anna Chapman. On July 3, the attractive redhead who was swept up with nine other sleeper agents and deported from the U.S. in 2010 tweeted, "Snowden, will you marry me?"

"The only thing really he's got now is either minimize the penalties going forward or work out some favorable resolution he's comfortable with somewhere in the world," Zaid said of Snowden.

And even then, it would be difficult for the U.S. government to negotiate, he said.

"Because it's not just about Snowden anymore," Zaid said. "It's about anyone who would follow in his footsteps."

Graymail is a common defense tactic, and three decades ago a law was passed to combat it. Attorneys say the law was meant to let judges sort out the classified information behind closed doors and determine what the defense genuinely needs to make public. If the judge concludes the defendant cannot get a fair trial without spilling secrets, the government can decide whether to go forward or drop the case.

But Snowden has yet to enter into court proceedings. The government is in the process of trying to extradite him to face the charges.

U.S. officials have said what Snowden already released will harm national security, though it's too early to tell what damage has been done. The U.S. intelligence community has a good idea of what other documents he has.

"I wouldn't describe it as graymail," Chertoff said. "I would describe it as blackmail."

As Chertoff sees it, Snowden's message to the government is this: "If you do anything that Snowden doesn't like he's going to try to hurt you by putting out information that could be damaging."

"To me, that's extortion," Chertoff said.

When Snowden arrived at Moscow's international airport on June 23 he was believed to be planning simply to transfer to a flight to Cuba and then to Venezuela to seek asylum. But the U. S. canceled his passport, stranding him. He hasn't been seen in public since, although he met with human rights activists and lawyers on June 12. He's applied for temporary asylum in Russia and has said he'd like to visit the countries that offered him permanent asylum ? Venezuela, Bolivia and Nicaragua.

Sky TV launches their own Apple TV competitor for the low low price of ?9.99

British pay-TV provider Sky has released their own Apple TV competing streaming box under their Now TV brand. The box ? which is essentially a Roku box re-branded ? costs a ridiculously low ?9.99 including shipping, and will stream services from Now TV, Spotify and the BBC among others. From the Now TV announcement:

Despite the explosion in devices such as games consoles and connected TVs, there are still up to tens of millions of TVs in the UK that can?t currently connect to the internet. If you own one of these TVs, the NOW TV Box is the perfect way to watch your favourite content back on the big screen.

The Apple TV already sets the bar as far as TV-connected streaming boxes goes, with a decent selection of content available in an already reasonably priced package. Google now has Chromecast, a $35 dongle that brings connected content to your TV via your Android or iOS device, but Sky has managed to price theirs so low that it becomes a true impulse buy.

But, in being only ?9.99, the Now TV box is effectively subsidized. In buying one, to get to the premium content you'll require a paid subscription either to Now TV or the Sky Movie pass. A 30-day free trial of the latter is available to get you up and running, but it's not terribly clear whether or not you'll need to keep paying a subscription in order to access the non-Sky content after that 30-days such as Spotify, Flickr, BBC iPlayer and Demand 5. If that's the case, it's a disappointment, but you can't fault Sky for their business model in trying to get people to adopt their online platform.

It also poses a good question in relation to the Apple TV, especially with rumors being rife about a hook-up with Time Warner Cable. Now TV offers ? albeit at a pretty steep price ? a la carte subscriptions to Sky Sports, a premium pay-channel package, in daily installments. It's about 10x more expensive than a monthly subscription if you bought it every day, but you're not going to buy it every day. You only pay when you want to watch. Pricing aside, is this the kind of model you'd be happy to see for more services to hit the Apple TV?

Comments?(2)???.?? Share??.??Email??.??Print??.??A+A- Property developer DLF said on Thursday it has agreed to sell its 74 percent stake in a life insurance joint venture with US-based Prudential International Insurance Holdings Ltd to Dewan Housing Finance Corp.

The company said the financial details of the deal will be disclosed after the transaction gets all approvals. DLF Pramerica Life Insurance Company is one of the two dozen Indian life insurers in which Prudential International Insurance, a unit of Prudential Financial Inc, owns 26 percent, the maximum permissible foreign holding.

U.S. makes it easier to sell medical supplies to Iran

WASHINGTON (Reuters) - The United States on Thursday expanded the list of medical devices that can be exported to Iran without special permission, as it seeks to show support for humanitarian needs in a country that has been hit hard by Western sanctions.

The United States and its European allies have tightened their economic sanctions on Iran to pressure the government to rein in its nuclear program, which the West suspects aims to produce a bomb. Iran says the program is for peaceful purposes such as generating electricity and making medical isotopes.

Iran's election of a relative moderate, Hassan Rouhani, last month has raised some hopes for a resolution of the long-running dispute over Iran's nuclear intentions.

U.S. officials have said they have tried to sanction Iran without unduly harming ordinary Iranians, granting licenses, for example, to U.S. companies that want to export pharmaceuticals, medical devices, food and other humanitarian goods to Iran.

But acknowledging the difficulties some companies still face, the U.S. Treasury Department on Thursday expanded the list of items that are permitted for export without a special application, adding devices like electrocardiograph and dialysis machines.

David Cohen, the Treasury's undersecretary for terrorism and financial intelligence, said the wider list should allow these medical supplies to get to Iranians more quickly.

"Safeguarding humanitarian trade is an important element of our policy (towards Iran)," Cohen said. "We will continue to apply powerful pressure on Iran while taking steps to ensure that we do not impact the humanitarian needs of the Iranian population."

Sanctions lawyers have said the blacklisting of Iran's major banks has made it extremely difficult to find smaller Iranian banks able to conduct licensed transactions for humanitarian goods, as well as international banks willing to deal with them.

Exports of U.S. pharmaceuticals to Iran were cut in half last year compared to 2011, a sign sanctions could be taking their toll on Iranians' access to basic medical supplies.

Government hospitals and pharmacies in Iran late last year also reported a widespread lack of drugs to treat cancer, multiple sclerosis, blood disorders and other serious conditions.

Cohen said the U.S. Treasury Department has met with many pharmaceutical and medical supply companies to explain how to work around sanctions.

Also on Thursday, the Treasury issued new guidelines clarifying that foreign financial institutions may process transactions for humanitarian goods without running afoul of U.S. law.

"We expect that today's actions... will ease lingering concern about the export to Iran of medicine and medical equipment," Cohen said.

The U.S. Treasury has said that Iran's government is largely to blame for any difficulty Iranians face in getting medical supplies, as the government gave its Health Ministry too little foreign currency to pay for medical imports.

Under U.S. sanctions, Iran's government can use the money it gets from oil imports to China, India and other buyers only for bilateral trade or humanitarian goods, including medical supplies.

Cohen said Iran has plenty of money for all the medical supplies it needs.

iPhone 5 accounts for half of Apple's smartphone sales, iPhone 4S takes 30%

More than half of all smartphones sold by Apple in June were the latest-generation iPhone 5, according to new data, while the iPhone 4S, first released in 2011, accounted for 30 percent of sales.

With the iPhone 5 taking 52 percent and the iPhone 4S earning 30 percent of sales, the remaining 18 percent were iPhone 4 sales, according to data released on Monday by Consumer Intelligence Research Partners to AppleInsider.

The data shows how the average selling price of the iPhone has steadily declined, as customers have increasingly turned to the legacy iPhone 4S and iPhone 4. When the iPhone 5 first launched, early adopters helped push it to 68 percent of all iPhone sales in October 2012, but its share quickly eased to 50 percent by December.

"iPhone 5 appears to have settled in at about half of all iPhone sales, nine months after its initial launch," CIRP said. "In contrast, the earlier flagship model, iPhone 4S, accounted for almost three-quarters of iPhone sales almost a year after its launch. Furthermore, iPhone 4S had 90 percent of all iPhone sales in the period immediately after launch , compared to about 70 percent for iPhone 5."

The data is yet another example of how the average selling price of the iPhone has declined as the smartphone market matures. Some market watchers expect that future growth in the smartphone space will come largely from low- and mid-tier handsets.

That's helped to fuel speculation that Apple will launch a new mid-tier iPhone this year that would allow the company to expand its addressable market. There have also been leaked renderings, 3D mockups, and even alleged parts of the anticipated "iPhone Lite."

Another element of growth for Apple has been carrier expansion, and the data released Monday by CIRP found that Apple's latest carrier partner in the U.S., T-Mobile, accounted for 12 percent of American sales. That meant T-Mobile exceeded Sprint, even though Sprint has a larger install base.

T-Mobile's strong start took share from AT&T, which dropped from 49 percent of sales to 44 percent, as well as Verizon, which fell from 39 percent to 34 percent. As the fourth-largest carrier in the U.S., T-Mobile has more aggressive pricing than its competitors and attracts budget-minded consumers, which could make it a key player if Apple were to release an "iPhone Lite."

Finally, CIRP's data found that more than half of iPhone buyers in June were upgrading from a competing platform or were buying their first smartphone. While 24 percent were switching from standard mobile phones, 26 percent jumped from Google's Android platform, and 7 percent came from BlackBerry. Among existing iPhone users, most ? 18 percent ? were upgrading from the iPhone 4, while 13 percent came from the iPhone 4S.

College Bookstores Ban Rolling Stone Issue Featuring Bombing Suspect

Boston Globe:

College bookstores in Boston and surrounding communities have reacted differently as they handle Friday?s release of the latest issue of Rolling Stone magazine, which features a controversial cover showing the face of accused Marathon bomber Dzhokhar Tsarnaev.

Some local campus stores will not sell the magazine issue at all. Some will keep a stock hidden and available by request only. Others will allow the copies to be sold and displayed as they usually are.

2016 GOP presidential hopefuls already trading blows

Sen. Ted Cruz, R-Texas, is pictured above.

Ask any potential 2016 candidate about their presidential aspirations, and you'll hear the usual non-answers: The next election is a long way off, I'm concentrating on my day job, and, by golly, presidential politics is the last thing on my mind.

The cagey answers are obligatory - anything more forthright would smack of unseemly ambition - but they're also usually rubbish.

Take Sen. Ted Cruz, R-Texas, interviewed Sunday on ABC's "This Week." Cruz, who is believed to be eyeing a presidential run in 2016, was fundraising in Iowa this weekend - a conspicuous and necessary stop for any presidential hopeful. ABC's Jon Karl tried repeatedly to coax something resembling candor out of Cruz, but the freshman Republican declined to take the bait.

Asked if he's running in 2016, Cruz responded: "We are having a national debate about which direction the country should go...And what I am doing now is trying to participate in that national debate. "

"I understand that everyone likes to focus on the politics," he added, but "I'm not focused on the politics."

Karl seemed to smell something funny. "Is it fair to say you're not?" he asked.

Cruz replied: "I've been in the Senate all of seven months. The last office I was elected to was student council. So this has been a bit of a whirlwind."

But despite his lack of expressed interest in the job, it's clear that Cruz would like to keep the door open. Some have raised questions about whether Cruz, born in Canada to a mother from Delaware, is even eligible to be president, given his foreign birth. In the interview with ABC, Cruz dismissed the doubters.

"My mother was born in Wilmington, Delaware," he explained. "She is a U.S. citizen. So I am a U.S. citizen by birth."

And the case is closed, as far as Cruz is concerned. "I'm not going to engage in a legal debate. The facts are clear," he said. "I can tell you where I was born and who my parents were. And then as a legal matter, others can worry about that. I'm not going to engage."

Cruz even managed to sneak in an underhanded dig at another potential GOP hopeful, staking out a platform as an unapologetic conservative that could serve him well in a presidential primary fight come 2016.

He again voiced his opposition to the Senate's comprehensive immigration reform bill, and knocked one of its Republican co-authors, Sen. Marco Rubio, R-Fla., who is also believed to be eyeballing a presidential run in 2016.

"I think [Rubio] believes in the [Senate] bill," Cruz said. But he added, "If the [Senate] bill became law, in another 10, 20 years, we wouldn't have 11 million people here illegally, we'd have 20 or 30 million."

And as Republicans consider 2016, Cruz said, they should seek a candidate who prizes purity over accommodation.

"You know if you look at the last 40 years, a consistent pattern emerges," he explained. "Republicans nominate a candidate for president who runs as a strong conservative, we win. And we nominate a moderate who doesn't run as a conservative, we lose."

Yankees say A-Rod won't rejoin team in Texas

BOSTON (AP) ? Alex Rodriguez is not ready to rejoin the New York Yankees.

The team said Rodriguez has a strained left quadriceps and won't be able to return this week in Texas, as had been planned. Instead, he will remain on the disabled list and go back to Tampa, Fla., "for rest and treatment," the Yankees said in a statement issued before their game against the Boston Red Sox on Sunday night.

Only a day before, it appeared A-Rod was on target to return from offseason hip surgery early this week. Now, it's unclear when he might be back at all.

It's the latest blow to the depleted Yankees, missing several injured stars almost all season. Derek Jeter, Mark Teixeira and Curtis Granderson came back and quickly got hurt again. Rodriguez didn't even finish his rehab assignment.

Rodriguez and manager Joe Girardi had said they were hoping the third baseman would be back for Tuesday night's game against the Rangers. But the three-time MVP was moved from third base to designated hitter for Saturday night's rehab game with Triple-A Scranton/Wilkes-Barre after feeling tightness in his quad and went 0 for 4 with three strikeouts.

He was sent Sunday to New York-Presbyterian Hospital to be examined by team doctor Christopher Ahmad, and an MRI showed a Grade 1 strain ? the least serious level. It's the same injury that landed Jeter on the 15-day DL after his one-game return from a broken ankle.

Jeter was injured July 11 and won't be back until late this month, at the earliest.

Before the quadriceps injury, the original plan was for Rodriguez to rejoin the Yankees on Monday in Texas. Girardi then told reporters at Fenway Park at about 5:50 p.m. on Sunday that Rodriguez might make his 2013 debut on Tuesday.

"I would be surprised if he played Monday. Tuesday's possible," Girardi said.

But at 7:37 p.m. ? about a half-hour before Sunday's game ? the Yankees sent reporters an email saying the nearly 38-year-old Rodriguez "will not be joining the team for its series in Texas."

Rodriguez had surgery on his left hip in January and hasn't played a major league game this season. His 20-day minor league rehab assignment expired on Sunday, and the Yankees had to activate him or leave him on the disabled list.

The team said it might petition Major League Baseball for another rehab assignment because of the new injury.

"I think we're all a little bit anxious to see how he looks physically and how he's moving," Girardi said before the results of the MRI were announced. "I've talked to people that have seen him and said he ran good yesterday. ... I am anxious to see. He hasn't played in a while and he's almost 38. You kind of want to see what you've got."

Rodriguez told reporters in Scranton, Pa., on Sunday that he expected to work out on Monday and be back in the lineup Tuesday. He wasn't sure if he would play third or DH upon his return, he said.

If Rodriguez can regain his MVP form ? rather than the one that got him benched during the 2012 playoffs ? his return would be a boost for a lineup that has been without most of its biggest stars.

Jeter went back on the disabled list Friday and has played only one big league game all season. Teixeira (wrist surgery), Granderson (broken pinkie), infielder Kevin Youkilis (back surgery) and catcher Francisco Cervelli (broken hand) are also injured.

During the offseason, Rodriguez's name surfaced in an investigation of Biogenesis, an anti-aging clinic in Florida linked with the distribution of performance-enhancing drugs. He met with investigators from Major League Baseball earlier this month.

Navalny emerges as head of new generation of Russian opposition

In a battle against President Vladimir Putin that has moved from the streets of Moscow to a courtroom, Alexei Navalny has emerged as the figurehead of a new generation of Russian opposition.

The 37-year-old anti-corruption campaigner, who was handed a five-year jail sentence for theft on Thursday then freed on bail on Friday, was one of the first protest leaders arrested when demonstrations against Putin took off in December 2011.

After 15 days in jail for obstructing police at a Moscow rally, Navalny emerged as a hero for the protesters, who chanted his name and gave his booming speeches the biggest cheers.

By the time the protests started to fade in the spring of 2012, Putin was back in the Kremlin as president while Navalny had established himself as the opposition's unofficial leader.

Tall, clean-cut, confident and articulate, Navalny has more potential than any other opposition leader to at least rattle, if not directly challenge, Putin.

Thursday's verdict was seen by many as a sign that the president himself sees him as a threat, even though opinion polls suggest his appeal does not go far beyond the big cities.

"Navalny's sentence looks less like punishment than an attempt to isolate him from society and the electoral process," said former finance minister Alexei Kudrin, a Putin ally.

The surprise decision to free Navalny on bail pending an appeal suggests Kudrin's remarks and protests by thousands of people in cities have caused the Kremlin to rethink.

Within hours, thousands of protesters were out on the streets chanting Navalny's name and "Freedom!" close to the Kremlin. Some wore badges with his name, others distributed leaflets with his portrait.

"If we have even just another couple of months to fight, we will fight," Navalny said after he won bail.

Navalny has not hidden his presidential ambitions and has registered as a candidate in a mayoral election in Moscow on September 8 even though polls suggest he had little chance of winning. Had he gone straight to jail, Navalny would not have been able to run but the bail decision means he now has a chance of staying in the race.

His sentence - on charges he denied of stealing from a state timber firm - is unlikely to be overturned on appeal and this will bar him from running in the 2018 presidential election.

But Navalny is a young politician for the former Soviet world, and he can bide his time. Even if Putin is re-elected in 2018 for another six years, he would be over 70 by 2024 while Navalny would still be under 50.

CATCHING A MOOD

The son of an army officer, Navalny grew up mainly in Obninsk, about 100 km (60 miles) southwest of Moscow. He has a law degree and also studied securities and exchanges.

He represents a new, Internet-savvy generation and is seen as a potential threat to Putin even though the former KGB spy runs a tightly controlled political system that he has crafted in 14 years as prime minister or president.

Navalny operates from a sparsely furnished office just off Moscow's Garden Ring road, one of the capital's main thoroughfares, with a small team assisting him in his campaigning against corruption, mostly centered around his blog.

Usually dressed casually in a T-shirt and jeans, or sometimes in an open shirt without a tie, he looks and sounds different from most Russian political figures - many of whom dress formally in suits and ties.

"Navalny is the only possible leader I see," a Moscow-based Western banker said of Navalny's position in Russia's fragmented opposition. "He has fire in those blue eyes of his."

Navalny frequently looked disinterested at opposition meetings discussing the protests but came to life at the protests, delivering tub-thumping speeches.

He has managed to grasp a mood change in Russia among the urban youth and growing middle class two decades after the Soviet Union collapsed.

"We are not cattle or slaves. We have a voice and we have the strength to defend it," Navalny said in a statement during his 15-day jail term in late 2011.

Such simple, defiant phrases quickly caught on, none more that his description of Putin's ruling United Russia as a party of "swindlers and thieves".

"I realize there is danger, but why should I be afraid?" he told Reuters in an interview at the start of the protests.

But indicating he was aware of the risks he faced, he said in a later interview: "You need to understand a very simple thing. To keep himself in power, Vladimir Putin is ready to go very far. Much further than just putting me or anybody else in prison. Much further."

COMPLEX CHARACTER

Yet Navalny's character and politics are also more complex than some admiring Western liberals might expect of a Yale-educated lawyer.

While his time in the United States on a fellowship at Yale has forced him at times into denying accusations from Putin supporters that he is a CIA plant, his hostile views on Muslim and Asian migration into Russia's Slavic heartland have at times obliged him to rebuff suggestions he has "fascist" tendencies.

Once an outspoken nationalist, he was expelled from a liberal opposition party and has promised to crack down on immigration from Central Asia and the Caucasus.

In 2007, Navalny was reported by a state news agency to have been involved in a brawl at a Moscow club. After being ejected by bouncers, he got into a fight on the street and was quoted as saying at the time that he had shot his opponent with an air pistol. Charges were later dropped.

He has toned down his rhetoric over the years and honed his image, focusing on his criticism of the authorities.

Shooting to prominence by challenging state companies such as pipeline operator Transneft to explain millions of dollars of unorthodox payments, Navalny struck a chord with millions of Russians disgusted by the ostentatious wealth of Moscow's elite.

He accused Putin of ruling a venal elite as "chairman of the board of Russia Inc" and, in his latest slight, compared the president to a toad unwilling to get off a pipeline representing Russia's vast oil wealth.

Opinion polls show Putin remains the most popular politician in Russia. But the longer Russia holds off on reforms to boost its economy, the greater Navalny's chances are of building support among frustrated voters in the big cities.

India-US naval ties have hit the "big time": US admiral

Ahead of Vice President Joe Biden's maiden visit to India, a top US naval commander has said ties between the navies of the two countries have hit the "big time" as they are conducting coordinated operations.

Chief of Naval Operations Admiral Jonathan W Greenert characterised navy-to-navy ties as "solid and growing" and said bilateral wargames had progressed from "two ships going by doing flashing lights probably about a decade ago, to coordinated operations, carrier air wing and under sea".

"And that's when you hit the big time, when you can work with a partner under the water and ensure yourself, you're not going to run into each other, and we are at that level with the Indian Navy," Greenert told reporters in response to a question about the US re-balancing its strategy in Asia Pacific.

His comments came ahead of Biden's four-day visit to India starting Monday, July 22. Biden will hold meetings with the top leadership, including President Pranab Mukherjee and Prime Minister Manmohan Singh.

Greenert, however, said the India-US Malabar naval exercise had been scaled down because of "issues" on both sides. He did not give details about the move.

"We had to de-scope it some, because of each of our issues but we've kept the exercise and we've kept it as high-end and complex," he said.

"It just may not run as long. So I'm comfortable at that level, and we try to work to the level that resonates with both our navies."

On ties between the US and Chinese navies, Greenert said, "I like the trend we're on right now and working toward and, in some cases, getting some tangible outcome of working together.

"We operated together a humanitarian assistance, disaster relief scenario, doing command-and-control together, doing the proper protocols at sea, and we agree, this needs to continue."

... contd.
